Terms and conditions: (a) “racs_aus” means Retail & Corporate Solutions Pty Ltd (ACN 110 373 996) selling goods online to the Purchaser as identified in racs_aus eBay listing. (b) “Purchaser” means the person or legal entity that is the successful bidder for the goods identified in racs_aus eBay listing. (c) “Contract” means a contract for sale of goods online by racs_aus to the Purchaser incorporating these Terms and Conditions. 2. FORMATION OF CONTRACT (a) All goods sold online by racs_aus are subject to these Terms and Conditions to the exclusion of any other terms and conditions stipulated or referred to by the Purchaser. The Purchaser acknowledges that it is aware of the contents of, and agrees to be bound by, these Terms and Conditions. 3. ORDERS, PRICE AND PAYMENT (a) The Purchaser must pay the purchase price stated in the ‘winners email’ confirmation to racs_aus via direct bank deposit, money order or bank cheque. (b) The Purchaser must pay for all delivery, insurance and handling charges as stated in the item description, and any applicable customs or duty charges applicable for delivery to the designated delivery address. (c) racs_aus obligation to deliver the goods is subject to it receiving payment in full in cleared funds. (d) racs_aus is not liable for any delay in delivery of the goods, due to customers not using there eBay ‘User ID’ as a reference or not paying the exact required amount when any form of payment is being made. 4. TITLE AND RISK (a) Title to and risk in the goods passes to the Purchaser upon delivery of the goods to the Purchaser. 5. DELIVERY (a) racs_aus will deliver the goods to the place of delivery designated by the Purchaser in the eBay ‘Checkout’ when it is completed on or before the day of auction close. If the 'Checkout' is uncompleted the eBay registration details will be used. 'Checkout' completion after the day of the auction close will be considered but is not guarenteed. Delivery of the goods will be deemed to have taken place on delivery of the goods to such address. (b) Any dates and time frames quoted by racs_aus for delivery of the goods are approximate only and do not form part of the Contract. (c) racs_aus is not liable for any delay in delivery of the goods, howsoever caused. (d) The shipping and handling charged with your order by racs_aus is a non-refundable cost, unless the item you purchased was listed incorrectly online or you were shipped a different product than you ordered (miss-ship). (e) racs_aus does not allow pick up of orders under any circumstances unless clearly stated in the eBay item description. (f) Freight costs and shipment methods are not negotiable. Bidder's can reserve their right not to bid on Retail & Corporate Solutions items if they believe the freight charge is not competitive. (g) Please allow sufficient time for delivery. In most cases your item will be received in around 2 to 4 days. (h) In the event of a delivery not arriving as addressed due to lost in transit, theft, damage or miss-delivery by our freight forwarder; allow up to 45 days from the date shipped for investigations to be completed and the item declared lost. Once an investigation is completed resulting in a non-delivery; a refund, replacement or substitute will be processed at the discretion of RACS. RACS reserves the right to determine the appropriate course of action. (i) Customs/Duty charges may apply to deliveries for international purchases. These costs are not included in the total the Purchaser pays racs_aus and will be paid by the Purchaser to the relevant customs office if required for delivery. Non-payment of customs/duty can result in destruction of the goods, which is then considered to be delivered in full. 6. ACCEPTANCE OF GOODS (a) Unless the Purchaser notifies racs_aus to the contrary on the day of delivery and such notification is confirmed in writing within 2 days, the goods will be deemed to have been accepted by the Purchaser as being in good condition and in accordance with the Contract. (b) racs_aus only permits the return of unopened goods where racs_aus shipping or order processing error is made and all other sales are final. Before returning any goods the Purchaser must contact racs_aus to make arrangements for return of the goods. 7. FORCE MAJEURE (a) If the performance of racs_aus obligations under these Terms and Conditions is delayed or prevented by any cause or causes beyond racs_aus control, racs_aus will be entitled to terminate the Contract or suspend its duty to perform for as long as the circumstances amounting to force majeure continue. Force majeure circumstances include, without limitation, adverse weather conditions, industrial action, war, fire, accidents, delay by supplier, difficulties in transport, breakdown in machinery or plant and shortage of materials or labour. racs_aus will not be liable for any costs arising out of termination of the Contract or suspension of its duty to perform its obligations under these Terms and Conditions. 8. WARRANTY AND LIABILITY (a) While not affecting any non-excludable warranty or guarantee implied by law, racs_aus does not give any warranty that the goods are fit for any particular purpose and all warranties, conditions, terms, undertakings and obligations implied by statute or common law, trade usage, course of dealing or otherwise including warranties or conditions of, merchantability, fitness for purpose, satisfactory quality and/or compliance with description are hereby excluded to the fullest extent permitted by law. (b) If the goods are covered by a relevant manufacturer’s or distributors warranty, the Purchaser must contact the manufacturer or distributor in respect of any warranty claims or issues relating to the goods, including any replacement or repair to the goods. racs_aus does not any imply or supply direct warranty services including replacing or repairing faulty goods unless clearly stated in the eBay item description. (c) To the extent permitted by law and subject to clause 8. (f) racs_aus total liability under these Terms and Conditions will not exceed the total price paid for the purchase of goods under these Terms and Conditions. (d) In no event will racs_aus be liable for any incidental, indirect, special or consequential loss or damages arising out of or in connection with the purchase, use or performance of the goods. (e) To the extent permitted by law, any typographical, clerical or other error or omission in sales literature, quotation, price list, order confirmation, invoice or other documents or information issued by Racs_aus will be subject to correction without any liability on the part of Racs_aus. (f) Under the Act, where implied conditions and warranties cannot be excluded, Racs_aus liability for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) will be limited, at Racs_aus option, to the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods. 9. INTELLECTUAL PROPERTY RIGHTS (a) racs_aus does not warrant that the goods are free from infringement of intellectual property rights in any country nor that the use of such goods in any country is free from infringement. 10. ENFORCEABILITY (a) If any provision of these Terms and Conditions is held invalid, unenforceable or illegal for any reason, these Terms and Conditions shall remain in full force apart from such provision that shall be deemed deleted. 11. LAW AND JURISDICTION (a) This agreement shall be governed by and construed in accordance with the laws of New South Wales Australia and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales Australia.
